Abstract

The article examines the problems of fragmented regulation of the legal profession in the Republic of Kazakhstan and the prospects for establishing a unified self-regulatory organization. The relevance of the topic is обусловлена the existence of numerous parallel professional associations (48 Chambers of Legal Consultants and the Republican Bar Association), which results in the absence of unified standards for the provision of legal assistance, discrepancies in qualification requirements and disciplinary practices, difficulties in protecting consumer rights, and a negative impact on the quality of legal services.

The purpose of the article is to analyze the existing regulatory models and to develop a conceptual framework for a unified self-regulatory organization based on democratic principles of governance. The methodological basis of the research includes systemic, comparative-legal, and formal-legal analysis, as well as elements of institutional forecasting.

Three development scenarios are considered: voluntary unification, legislative consolidation, and preservation of the status quo. The optimality of a phased voluntary unification with the establishment of a coordination council at the initial stage is substantiated. An institutional model of a unified organization is proposed, including limitations on executive powers, an independent disciplinary commission, guaranteed regional representation, transparent budget governance, and mechanisms for convening extraordinary general meetings. The role of the KazBar Chamber as a catalyst for consolidation processes is defined.

Practical recommendations aimed at improving the quality of legal services and strengthening the independence of the profession are formulated. The article concludes that the establishment of a unified self-regulatory organization based on democratic principles constitutes a necessary condition for the development of the rule of law and for ensuring genuine access of citizens to qualified legal assistance in Kazakhstan.
