CONSTITUTIONAL LAWAbstract
The article is devoted to the problems of imperfection of the electoral legislation of the Republic of Kazakhstan. The author draws attention to contradictions between the current legal norms and the principles of a democratic society. Based on the analysis of Kazakhstani and foreign practice, it is concluded that elections in Kazakhstan have lost their democratic nature and require fundamental reform. Institutional and procedural barriers restricting participation in presidential elections are examined. The necessity of changing the model of power formation with an emphasis on representation and accountability is substantiated. A new model of participation of labor collectives in nominating candidates is also proposed. The article provides a comprehensive analysis of the constitutional and legislative mechanisms regulating electoral processes and assesses their impact on political competition and the legitimacy of elections. Particular attention is paid to the formation of election commissions, electoral qualifications, and candidate registration procedures. The author outlines the risks associated with preserving the current electoral model and justifies the need for institutional reforms aimed at strengthening democratic principles, enhancing transparency, and increasing public trust in the electoral system.
