On the development of the principles civil legislation

Abstract

The article is based on a major event in the jurisprudence of Tajikistan - the adoption of a new edition of all three parts of the national Civil Code. It was determined that the purpose of the modernization of civil legislation was the need to bring the issues of regulation of socially important relations in line with the requirements of modernity. The main attention in the article is paid to a preliminary analysis of the innovations of the new Civil Code, first of all, the basic principles of civil law, which determine the basis of civil law regulation. Exploring these principles of law, taking into account the opinions of other scientists, including the proposals of Yu.G. Basin, the author offers his own subjective opinion about the nature of some of them.
